A Florida court has officially cleared five Argentine nationals of retail theft charges, ending a months-long legal battle that began with their arrest at a Miami shopping center in December 2025. The five tourists, all from the province of Mendoza, were initially accused of operating as part of a criminal organization targeting luxury stores at the Dolphin Mall.
Defense attorney Roberto Castillo confirmed this week that the state has dropped all charges against the group. The dismissal follows a gradual erosion of the prosecution's case, which began in January when officials abandoned the most serious allegations of organized criminal activity.
A case built on lack of evidence
Local authorities in Sweetwater had initially alleged that the group utilized a common theft tactic: stealing suitcases from one store and using them to conceal merchandise from other retailers. Police reports claimed the group targeted brands including Tommy Hilfiger, Columbia, and The North Face, with officers seizing approximately $2,000 worth of goods during the December arrests.
However, the defense maintained throughout the process that the police response was an overreaction and that the state lacked the evidence necessary to prove a coordinated criminal structure. Under the Florida judicial system, prosecutors have broad discretion to drop cases if they determine the evidence is too weak to withstand a jury trial. By April, the state conceded that the remaining theft charges could not be sustained.
Following their initial release on a $4,000 bond each, the five individuals returned to Argentina via Santiago, Chile. They monitored the remainder of the legal proceedings from their home country.
The final dismissal means the group will not carry a criminal record in the United States. According to their legal team, the resolution also ensures the individuals face no future immigration restrictions, allowing them to re-enter the country without legal interference.
